The Supreme Court annulled the trial of civilians in military courts

Islam Abad(94 news) The Supreme Court quashed the trials of civilians in military courts and accepted petitions against the trials of civilians in military courts.

A 5-member larger bench headed by Justice Ijaz-ul-Ahsan gave a verdict, the trial of civilians in the military courts was unanimously annulled.

The Supreme Court has said in the decision that if a civilian has had a military trial, it is declared null and void. Section 2D1 of the Army Act is in conflict with the Constitution. Justice Yahya Afridi reserved his opinion on declaring the sections of the Army Act unconstitutional.

In the brief judgment, it is said that the remaining decision of the Supreme Court is by the majority of 5 judges, the decision will be applied to all the persons detained in the incidents of May 9 and 10.

The trial case of civilians in the military courts was heard in the Supreme Court. A 5-member larger bench headed by Justice Ijazul Ahsan heard the case. Justice Ijazul Ahsan said how civilians come under the ambit of the Army Act. Justice Ayesha Malik said what does Article 8 of the Constitution say, Mr. Attorney General? He said that the Army Act is for the establishment of discipline in the forces, how can the existing law for the discipline of the forces be applied to civilians?

Justice Ayesha Malik asked the Attorney General that how can the 21st constitutional amendment be defended? The Attorney General said that the discipline of the forces is internal while obstructing the performance of duties is an external matter. The Attorney General said that anyone who falls under this category can be tried in the military courts. Justice Ijazul Hassan said that the laws you are referring to are related to the discipline of the army. Discipline, how can the rules of suspension of fundamental rights be applied? If the court opens this door, the traffic signal breaker will also be deprived of fundamental rights, should we interpret the constitution that fundamental rights can be suspended when the heart wants to.
