The High Court remanded the case to the Sessions Court overturning the decision to reject the bail of Engineer Muhammad Ali Mirza


Rawalpindi (94 news) The Rawalpindi Bench of the High Court annulled the decision to reject the bail of religious scholar Engineer Muhammad Ali Mirza and sent the case back to the Sessions Court.
According to the details, the bail case of Engineer Muhammad Ali Mirza was heard by Justice Sadaqat Ali Khan of Lahore High Court Rawalpindi Bench. The court remanded the decision of the Sessions Court and directed that all the records and documents be re-examined and re-declared.
According to Ali Mirza's lawyer, Advocate Dr. Tahir Ayubi, "This is the first time that the High Court has sent back the decision to reject bail in a blasphemy case and ordered a rehearing."
On the other hand, a hearing was held in the Islamabad High Court on the request to annul the resolution regarding the conviction of engineer Muhammad Ali Mirza as guilty of insolence.
During the hearing, the Islamic Ideology Council has not yet submitted a written response, on which the court ordered the council to submit a response by giving a deadline of one week.
Meanwhile, a separate application for becoming a party was also filed by Engineer Mirza, but the Registrar's Office raised objections to it. The lawyer told the court that due to these objections, the application could not be scheduled for hearing.
Justice Mohsin Akhtar Kayani remarked that the objections should be removed first, after which a decision will be given on the application to become a party. He added that if action is being taken based on the opinion of the Islamic Ideological Council, then all blasphemy cases should also be referred to the same council.
Lawyer Dr. Aslam Khaki took the position that the Islamic Ideological Council has exceeded its authority, because it is authorized to give an opinion only on the request of the President or the Governor. Justice Mohsin Akhtar Kayani gave a sarcastic remark and said, "It is possible that now they have been given investigative powers."
The lawyer pleaded that the resolution passed by the council against Mirza should be suspended, but the court said that an interim order cannot be issued until the other side responds.
